Acceptable Use Policy

INTERNET ACCEPTABLE USE POLICY

All Partner Communications Customers should read this document! Even if you don't read it, you are still responsible for the policy written here, and your account WILL BE DISABLED WITHOUT WARNING if you violate it.

Partner Communications sets forth an Acceptable Use Policy (AUP) with the intent of protecting our service, our customers, and other users of the Internet from potentially abusive actions taken by Partner Communications customers. The following policy is non-exclusive; any action about which there is doubt should be referred to Partner Communications for evaluation. Partner Communications may alter this policy from time to time as need dictates. Updated policies will be posted on Partner Communications website at http://www.pcctel.net.

Compliance Required 

All customers must comply with this AUP.  Partner Communications reserves the right to terminate or suspend service immediately or to otherwise disconnect, remove, block, filter or restrict your use of service if Partner Communications determines, in its sole discretion, that such use violates this AUP.  Partner Communications will cooperate with legal authorities and/or third parties in the investigation of any suspected or alleged crime or civil wrong.  If Partner Communications believes that you have used service for an unlawful or unauthorized purpose, Partner Communications may forward the relevant communication and other information, including your identity, to the appropriate authorities for investigation and prosecution. You hereby consent to Partner Communications' forwarding of any such communications and information to these authorities.  In addition, Partner Communications may provide information in response to law enforcement requests, lawful government requests, subpoenas, and court orders, to protect its rights and property and in the case where failure to disclose the information may lead to imminent harm to you or others.

Service Monitoring 

Partner Communications is under no obligation to monitor a customer's usage, bandwidth, transmissions and/or content of service.  However, Partner Communications may monitor the usage, bandwidth, transmissions and content of service periodically to (i) comply with any necessary laws, regulations or other governmental requests or (ii) operate service properly or to protect itself, its network and its customers and subscribers.  Partner Communications reserves the right to modify, reject or eliminate any information residing on or transmitted to its server that it, in its sole discretion, believes is unacceptable or in violation of this AUP or any other terms and provisions applicable to service.

Statement of Responsibility

  • Each Partner Communications Internet account has a password that is the key to gain access to the account. The customer who registered the account is solely responsible for all access and actions taken with regard to the account. It is the account owner's responsibility to safeguard the account password and to ensure that Partner Communications Acceptable Use Policies are honored. Partner Communications will hold the account owner responsible for any violations of the AUP.
  • Sites directly attached to the Partner Communications backbone are expected to adhere to the Partner Communications Acceptable Use Policies. The individual who signed the contract is responsible for educating site users on acceptable use policies. Violations of the AUP by directly attached sites will be referred to the contract signer for resolution. The contract signer will be held responsible for any violations of the AUP.
  • Partner Communications enforces these policies with respect to Partner Communications customers only. We are not responsible for abusive actions which originate from other sites or networks on the Internet.

Acceptable Use: Network
Acceptable use of the Partner Communications network facilities does NOT include:

  • Attempting to circumvent user authentication or security of any host, network, or account on Partner Communications systems or the Internet at large ("cracking"). This includes scanning or probing ports without the consent of the owner of the machine being scanned.
  • Use of Partner Communications systems or networks (willfully or negligently) in a manner that encumbers disk space, processors, bandwidth, or other system resources so as to interfere with others' normal use of services on Partner Communications or other systems and networks ("denial of service" attack).
  • Using the Partner Communications network facilities in any manner that violates local, state or federal law.

Acceptable Use: Shell/Telnet Access
Acceptable use of shell/telnet access does NOT include:

  • Unauthorized access.
  • Running background processes after you have logged out.
  • Compiling and running foreign binaries without express written consent of Partner Communications.
  • Using the shell/telnet access in any manner that violates local, state or federal law.

Acceptable Use: Domain Names
Partner Communications provides domain name service for Dedicated Connection, Enhanced Showcase, and UUCP customers. Keeping registry information updated and accurate is the responsibility of the domain holder and not Partner Communications. Acceptable use of the Partner Communications domain name service does NOT include:

  • Falsifying or omitting valid domain contact information, including the administrative, technical, zone, and billing contacts.

Acceptable Use: Email
Acceptable use of Email does NOT include:

  • Sending unsolicited mass mailings of any nature, including those with a "negative option" for continuation. The negative option is inviting those who do not wish to receive more email to reply to you.
  • Sending a large number of email messages, or singularly large email messages, to a single address in order to flood someone's mailbox.
  • Forging email headers to obscure the true originator of the message.
  • Creating or participating in pyramid schemes or chain letters.
  • Sending harassing email, either by language, size, or frequency. This includes sending email (or real time) messages to a person who has asked explicitly that you do not.
  • Using email in any manner that violates local, state or federal law, including without limitation using email to transmit any material whose transmission is unlawful under any local, state or federal law applicable to such transmission.

Acceptable Use: Usenet
Acceptable use of Partner Communications Usenet News service does NOT include:

  • Posting unsolicited messages to a large number of Usenet newsgroups either by cross-posting or posting to individual groups ("spamming").
  • Attempting to cancel, supersede, or otherwise interfere with Usenet posts other than one's own.
  • Blatant posting of articles which violate the named charter for specific newsgroups.
  • Publishing someone's real-world data (such as phone number, address, social security number, etc.) in such a way as to cause the person trouble or to incite others to do so.
  • Forging Usenet header information to obscure the true originator of the message.
  • Using the Partner Communications Usenet in any manner that violates local, state or federal law.

Acceptable Use: Dial-up Access

  • Dial-up connections to Partner Communications that are idle for 20 minutes or longer, or connected for more than 24 hours continuously, will be disconnected. Idle time is defined as a period during which no input or output is sent or received across the modem connection.
  • Multiple simultaneous logins to a single Partner Communications dial-up account are prohibited.
  • While our service is unlimited, it is not a dedicated modem connection. Use of Partner Communications dial-up service as a dedicated modem connection through use of re-dialers and idle-time traffic generators is prohibited.
  • Dialup accounts with only 1-800 number access are considered abandoned if unaccessed for three consecutive months. Partner Communications will remove abandoned accounts on the first of the month without notice unless you make special arrangements in advance.
  • Using dial-up access in a manner that violates local, state or federal law.

Acceptable Use: Web/FTP Sites
Acceptable use of Partner Communications web/FTP space does NOT include:

  • · Distribution of pornographic or otherwise indecent or offending materials;
  • · Using internet service in any manner that violates local, state or federal law, including without limitation using internet service to transmit any material (by e-mail or otherwise) whose transmission is unlawful under any local, state or federal law applicable to such transmission;
  • · Using internet service to harm, or attempt to harm, minors in any way;
  • · Using internet service to transmit any material (by e-mail or otherwise) that infringes any copyright, trademark, patent, trade secret, or other proprietary rights of Partner Communications or any third party, including, but not limited to, the unauthorized copying of copyrighted material, the digitization and distribution of photographs from magazines, books, or other copyrighted sources, and the unauthorized transmittal of copyrighted software.
 
The examples of unlawful or unauthorized activities listed herein are non-exclusive and are provided solely for guidance to customers.  Partner Communications reserves the right to take action on unlawful or unauthorized activities which are not specifically listed in the AUP.
 

READ CAREFULLY: By signing THE SERVICE AGREEMENT AND/OR USING SERVICE, you acknowledge that you have carefully reviewed and are fully familiar with this Acceptable Use Policy, and you agree to comply with all of the terms, conditions and provisions contained herein.
